Terms of Service

These Terms are a binding agreement between you and Sakhile Mamba, trading as QuickMingles, a sole trader in Eswatini ("we", "us"). By opening quickmingles.com or using the service you accept them and our Community Rules, which form part of this agreement. If you do not accept them, do not use the service.
1. Who we are
QuickMingles is operated by Sakhile Mamba, sole trader, of Plot 44, Orange Groove, Tubungu Estates, Matsapha, Eswatini. You can reach us at support@quickmingles.com.
2. You must be 18 or older
The service is strictly for adults. By using it you represent and warrant that you are at least 18 years old and have the legal capacity to enter this agreement. Use by anyone under 18 is prohibited. If we learn that a user is under 18 we will terminate their access.
3. What the service is
QuickMingles connects you at random with another person for a live video conversation. Free random chat is available to everyone. An optional paid pass lets you choose interests so that we try to match you with someone who chose at least one of the same. What that pass does, and what it does not do, is described on our Features page.
The video and audio travel directly between you and the other person wherever the network allows it. We do not sit in the middle of that stream and we do not record it.
4. You are responsible for what you do here
You are solely responsible for your own conduct, for everything you show, say, type or transmit, and for the consequences of it. You agree to follow the Community Rules and all laws that apply to you.
5. Other people are not our responsibility
QuickMingles puts you in contact with strangers. We do not vet, verify, screen or background-check anyone, and we do not confirm that anyone is who or what they claim to be. Apart from an automated check that a face can be detected on camera — which runs on the two devices in the call, not on our servers — chats are not monitored while they happen. You acknowledge that you may encounter behaviour or content that is offensive, indecent, harmful or unlawful, and that you use the service at your own risk.
You are solely responsible for your interactions with other users. We have no obligation to become involved in disputes between users, though we may do so at our discretion.
6. Things you must not do
You must not use the service in breach of the Community Rules; harass, threaten, defraud or harm anyone; transmit unlawful content; impersonate anyone; record another person without their consent; use bots, scripts or automation; attempt to gain unauthorised access to our systems; or interfere with the service's operation or security.
7. Payment, passes and pricing
The paid pass is a one-off purchase giving access to interest matching for a fixed period. It is not a subscription and does not renew: nothing is charged again unless you choose to buy again. The current price and duration are shown on the site before you pay and on the checkout itself.
Payments are handled by Paddle.com Market Ltd, which acts as the Merchant of Record and is the seller for the transaction. Your purchase is also subject to Paddle's own terms, presented at checkout. We never receive or hold your card details.
A pass is tied to one active session at a time. Using it in a second browser ends its use in the first. Passes are for your personal use and must not be shared, sold or transferred.
8. Refunds
Passes are non-refundable. Access is granted immediately on payment, and by buying a pass you ask us to begin performance at once and accept that you lose any right to cancel once the pass is active. The single exception is where interest matching did not function at all for the entire life of your pass through a fault on our side; billing errors such as a duplicate charge are corrected regardless. This is set out in full in our Refund Policy, which forms part of these Terms, and none of it limits rights you have under the consumer law that applies to you.
9. Suspension and termination
We may suspend or terminate your access at any time, with or without notice, including where we believe you have broken these Terms or the Community Rules, or where we consider it necessary to protect other users or ourselves. Where access is terminated for a breach, any unused portion of a pass is forfeited and no refund is due.
10. The service is provided "as is"
To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, quality, or non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that you will be matched with anyone, or with anyone you find agreeable.
The service depends on your device, your camera and microphone, your internet connection, and networks we do not control. Connections between users fail for reasons outside our control and we do not guarantee that any particular call will connect.
QuickMingles is not an emergency service. Never rely on it to contact emergency assistance.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, data, goodwill or reputation, arising out of or connected with your use of the service, whether in contract, tort (including negligence), or any other legal theory, and whether or not we were advised of the possibility.
In particular, and to the fullest extent permitted by law, we are not liable for the conduct of any user, whether online or offline, including anything another user says, shows, transmits, records or does, and including any meeting arranged through the service.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the service is limited to the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 20.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you; in that case our liability is limited to the least extent permitted by law.
12. Indemnity
You agree to indemnify, defend and hold harmless Sakhile Mamba, trading as QuickMingles, and any of our agents and contractors, against all claims, demands, proceedings, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or connected with your use of the service, your content or conduct, your breach of these Terms or the Community Rules, or your violation of any law or of anyone else's rights.
13. Third-party services
The service relies on third parties, including Paddle for payment and public STUN servers to help establish connections. Their handling of your information is governed by their own terms and policies, and we are not responsible for them.
14. Intellectual property
The QuickMingles name, the site and its software are ours or our licensors'. You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the service as intended. You keep whatever rights you have in your own content; we do not claim ownership of it and, since we do not record calls, we do not store it.
15. Changes
We may change these Terms. Where changes are material we will update the date at the top of this page. Continuing to use the service after a change means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the Kingdom of Eswatini. The courts of Eswatini have exclusive jurisdiction over any dispute, except that if you are a consumer resident elsewhere, you may also have the benefit of mandatory protections and courts in your country of residence, and nothing here removes those.
17. General
If any provision of these Terms is held unenforceable, the rest remain in force and the unenforceable part is applied to the maximum extent permitted. Our failure to enforce a provision is not a waiver of it. These Terms, with the Community Rules and Refund Policy, are the entire agreement between us about the service.
